TERMS AND CONDITIONS OF SERVICE

These Terms and Conditions (“Terms”) govern all work carried out by [Your Name], trading as [Your Business Name] (“the Trader”), a sole trader registered in England and Wales. By accepting a quote or allowing work to commence, you (“the Customer”) agree to these Terms in full.

 

1. Quotes and Estimates

1.1  A written quote is a fixed price for the described scope of work. A written estimate is an approximate cost based on information available at the time and may vary.

1.2  All quotes are valid for 30 days from the date of issue, unless otherwise stated.

1.3  Quotes and estimates are based on the information provided by the Customer. If additional work or materials are required beyond the agreed scope, the Trader will inform the Customer and obtain approval before proceeding.

1.4  Quotes do not include the cost of third-party services, permits, or specialist equipment unless explicitly stated.

 

2. Acceptance of Work

2.1  A contract is formed when the Customer accepts a quote in writing (including by email or text message), pays a deposit, or permits work to commence.

2.2  The Trader reserves the right to refuse any work at their discretion.

 

3. Right to Cancel (Domestic Customers)

3.1  Where a contract is entered into remotely (e.g. by phone, email, or online) or away from the Trader’s business premises, domestic customers have the right to cancel within 14 days of agreeing to the contract under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

3.2  If the Customer requests work to begin within the 14-day cancellation period and subsequently cancels, the Trader is entitled to charge for work already carried out and materials already purchased.

3.3  Cancellation requests must be made in writing (email or letter). The Trader will acknowledge receipt within 2 business days.

 

4. Payment Terms

4.1  A deposit of [e.g. 25%–50%] of the total quoted price may be required before work commences, particularly where materials need to be ordered.

4.2  The remaining balance is due on completion of the work unless otherwise agreed in writing.

4.3  Payment is accepted by bank transfer / cash / card. Bank transfer details will be provided on the invoice.

4.4  Invoices are payable upon receipt of the invoice unless otherwise agreed.

4.5  Late payments will incur interest at 8% per annum above the Bank of England base rate, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998, plus reasonable debt recovery costs.

4.6  The Trader reserves the right to cease work if payment is overdue.

 

5. Materials

5.1  Where the Trader supplies materials, these will be of satisfactory quality and fit for purpose. The cost of materials will be included in the quote or invoiced separately.

5.2  Where the Customer supplies materials, the Trader accepts no liability for defects in or unsuitability of those materials.

5.3  Unused materials purchased specifically for the Customer’s job remain the property of the Trader unless otherwise agreed.

 

6. Changes to Scope of Work

6.1  Any variations to the original scope of work must be agreed in writing before additional work begins.

6.2  Additional work will be charged at the Trader’s standard day rate of £[insert rate] per day / £[insert rate] per hour, or by agreed fixed price.

6.3  Unforeseen circumstances (e.g. concealed pipework, structural issues, or rot discovered during work) may result in additional charges. The Customer will be notified promptly and work will not proceed without approval.

 

7. Access and Working Conditions

7.1  The Customer must ensure safe and reasonable access to the property at the agreed time. If the Trader is unable to access the property through no fault of their own, a call-out fee of £40 may be charged.

7.2  The Customer is responsible for clearing the work area unless otherwise agreed.

7.3  The Trader reserves the right to stop work if conditions become unsafe.

 

8. Workmanship Guarantee

8.1  All work is carried out with reasonable care and skill in accordance with the Consumer Rights Act 2015.

8.2  The Trader offers a 12-month guarantee on workmanship for defects arising from the Trader’s own work, provided:

        The defect is reported to the Trader in writing within the guarantee period;

        The work has not been modified, misused, or interfered with by a third party;

        Payment in full has been received.

8.3  This guarantee does not cover fair wear and tear, damage caused by the Customer or third parties, or defects in Customer-supplied materials.

8.4  Manufacturer’s guarantees on materials and products are separate and remain between the Customer and the manufacturer.

 

9. Liability

9.1  The Trader’s total liability for any claim arising from work carried out shall not exceed the total amount paid by the Customer for that specific job.

9.2  The Trader is not liable for:

        Pre-existing defects or conditions at the property;

        Indirect or consequential losses (including loss of earnings or business losses);

        Damage caused by materials supplied by the Customer;

        Delays caused by circumstances outside the Trader’s reasonable control.

9.3  Nothing in these Terms limits liability for death or personal injury caused by the Trader’s negligence, or any other liability that cannot be excluded by law.

9.4  The Trader holds Public Liability Insurance to the value of £2 million. Details are available upon request.

 

10. Damage and Property

10.1  The Trader will take reasonable care to avoid damage to the Customer’s property. Any accidental damage must be reported by the Trader to the Customer immediately.

10.2  The Trader is not responsible for damage to concealed services (pipes, wiring, cables) that were not identified prior to work commencing, where the Customer failed to disclose or mark their location.

 

11. Health and Safety

11.1  The Trader will comply with all relevant health and safety legislation while on site.

11.2  The Customer must inform the Trader of any known hazards on the property (e.g. asbestos, lead paint, gas leaks, structural concerns) before work begins.

11.3  If the Trader identifies a safety concern during the course of work, they reserve the right to pause work and advise the Customer accordingly.

 

12. Permits and Permissions

12.1  Unless explicitly stated in the quote, it is the Customer’s responsibility to obtain any necessary planning permissions, building regulations approval, landlord consent, or other permits required for the work.

12.2  The Trader accepts no liability for work carried out without required permissions where the Customer confirmed these were not required or were the Customer’s responsibility.

 

13. Complaints

13.1  If the Customer is dissatisfied with the work carried out, they must notify the Trader in writing within 14 days of completion.

13.2  The Trader will respond within 5 working days and, where a genuine fault is identified, will return to remedy the issue at no additional cost.

13.4  If a complaint cannot be resolved, the Customer may seek independent advice from Citizens Advice, Trading Standards, or refer the matter to a relevant alternative dispute resolution (ADR) scheme.

 

14. Data Protection

14.1  The Trader will collect and hold personal data (name, address, contact details) solely for the purpose of delivering services and fulfilling contractual and legal obligations.

14.2  Personal data will not be shared with third parties except where required by law.

14.3  Data is processed in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

 

15. Governing Law

15.1  These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

 

16. Amendments

16.1  The Trader reserves the right to update these Terms from time to time. The version in force at the time a quote is accepted shall apply to that contract.
